1. Acceptance of Terms

By accessing or using PawCalm ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

PawCalm provides AI-generated suggestions and tools for dog separation anxiety training. The Service is provided for informational and educational purposes only.

3. Eligibility

You must be at least 18 years old to use PawCalm. By using the Service, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into these Terms.

4. Not Professional Advice

IMPORTANT: PawCalm does NOT provide professional veterinary, medical, or certified dog training advice. The AI-generated content is for informational purposes only and should not be considered a substitute for professional consultation.

You should always consult with a qualified veterinarian or certified animal behaviorist for serious behavioral issues. If your dog shows signs of aggression, self-harm, or severe anxiety, seek professional help immediately.

5. User Responsibilities

You are responsible for:

  • The safety and wellbeing of your pet
  • Determining whether any suggestions are appropriate for your specific situation
  • Supervising your pet during any training activities
  • Providing accurate information about your pet
  • Maintaining the confidentiality of your account
  • All activities that occur under your account

6. Assumption of Risk

YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT:

  • Dog training involves inherent risks including bites, scratches, property damage, and unpredictable animal behavior
  • You voluntarily assume all risks associated with using the Service and training your dog
  • You are solely responsible for any injuries or damages that may occur to you, your pet, other people, or property
  • PawCalm has no control over your actions or your pet's behavior

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PAWCALM AND ITS OWNERS, OPERATORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Injury to you, your pet, or any third party
  • Property damage
  • Loss of data
  • Loss of profits or revenue
  • Emotional distress
  • Veterinary or medical expenses
  • Any damages resulting from your use of or inability to use the Service

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO USE PAWCALM IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100 USD).

You use this Service entirely at your own risk.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT:

  • The Service will be uninterrupted or error-free
  • Any content or suggestions will be accurate, reliable, or effective
  • The Service will meet your requirements or expectations
  • Any errors will be corrected
  • The Service is free of viruses or harmful components

9. Indemnification

You agree to indemnify, defend, and hold harmless PawCalm and its owners, operators, employees, agents, and affiliates from and against any and all claims, damages, losses, costs, and expenses (including reasonable attorney fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any rights of a third party
  • Any claim that your use of the Service caused damage to a third party
  • Any injuries or damages caused by your pet

10. User Content

By uploading videos or other content, you grant PawCalm a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, and display this content for providing and improving the Service. You retain ownership of your content and can delete it at any time.

You represent and warrant that you own or have the necessary rights to any content you upload, and that your content does not violate any third party's rights.

11. Third-Party Trainers and Content

PawCalm may feature videos and content from third-party trainers. We do not employ these trainers and are not responsible for their content, advice, or actions. Any interactions or transactions with trainers through our marketplace are solely between you and the trainer. PawCalm is not liable for any disputes, damages, or issues arising from your interactions with third-party trainers.

12. Beta Service

PawCalm is currently in beta. This means:

  • Features may change, be removed, or malfunction without notice
  • Data may be lost or corrupted
  • The Service may be unavailable at times
  • We make no guarantees about the availability or functionality of any feature

By using the beta Service, you accept these additional risks.

13. Termination

We reserve the right to terminate or suspend your access to the Service at any time, for any reason, without notice. Upon termination, your right to use the Service ceases immediately.

14. Dispute Resolution

Informal Resolution: Before filing any legal claim, you agree to first contact us at legal@pawcalm.ai and attempt to resolve the dispute informally for at least 30 days.

Arbitration: Any dispute arising from these Terms or your use of the Service shall be resolved by binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in Massachusetts, and the arbitrator's decision shall be final and binding.

Class Action Waiver: YOU AGREE THAT ANY CLAIMS MUST BE BROUGHT IN YOUR INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

15. Changes to Terms

We may modify these Terms at any time by posting the revised Terms on the Service. Your continued use of the Service after changes constitutes acceptance of the new Terms. If you do not agree to the modified Terms, you must stop using the Service.

16. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy and Disclaimer, constitute the entire agreement between you and PawCalm regarding your use of the Service.

18. Governing Law

These Terms shall be governed by the laws of the Commonwealth of Massachusetts, United States, without regard to conflict of law principles.
